The Thomas Beagley Will
Transcription: This is the Last Will and Testamentof Mr. Thomas Beagley of Alton in the County of Northampton (sic) Bricklayer as follows -that is to say first I direct all my just debts funeral expenses and the charges of proving this my will to be fully paid and satisfied by my executors hereinafter named as soon as routinioustly(?) can be after my decease direct and bequeath the use and enjoyment of all myhousehold furniture and effects unto my dear wife Mary Ann for and during the term of her natural life provided she remains my widow. And from and after her decease or second marriage then I direct and bequeath the same or such of them or such part thereof as shall not have been theretofore consumed worn out or destroyed unto and between all my children living at her decease or second marriage equally to be divided by myExecutors and I direct and bequeath unto my brother James Beagley of Alton aforesaidBricklayer and my friends Benjamin Gollyor(?) of the same place Cooper and James Walker(?)of the same place Ostlor(?) whom I appoint joint Executors and trustees of this my will andto the survivors and survivors of them and the heirs executors administrators and assignersof such survivor All that my half share or interest of and in the freehold estate situateliving and being at Surbiton(?) in the said County of Southampton to which Sam Guilford(?)under the will of Mrs. Ann Crosby(?) deceased and also my estate right title and interestin and to certain leasehold dwellinghouses and premises situate in Superior(Seymour?) Street portman(Pelham?)Square and Pelham(?) Street Mile End in the County of Middlesex to which I am also entitledunder the same will in right of Ann Crosby my late wife and also all other myEstate and interest to which I am now or hereafter may become entitled either in rightof the said Ann Crosby my late wife or in my own right urnder the said will and allother my estate and effects whatever and wheresoever both real and personal upon atrust to pay the yearly rents issues and profits thereof as the same shall be received(?) or come(?)to their hands (after deducting the moneysary(?) outgoings in respect thereof) unto my saidwife Mary Ann for and during term of her natural life if she shall so long continuemy widow for the maintenance of herself and my four children namely Thomas James(?)Charles and George Beagley equally but if my said wife Mary Ann shall marry againthen immediately upon and after which? her second marriage or her Estate which mayfirst happen. I hereby direct my said executors and trustees and the survivors or survivorof them or the heirs executors or administrators of such survivor to make sale anddispose of my said freehold leasehold and other estates and property either by public orAuction or private sale as they shall think most advantagious and out of the moniesarising by or from such sale pay unto my said wife Mary Ann in the event of hersaid marriage instead of the rents? and profits thereof hereinbefore directed to be paid to herthe sum of fifty pounds which I hereby bequeath to her in lieu thereof and in lieu of alldower which she may claim in the said freehold estate or in any other partof the property I may dispossessed of and upon further trust that they my said Executorsand trustees or the survivors or survivor of them or the executors or administrators of suchsurvivor shall and so lay out and invest the widow of the monies to arise by sale ofmy said freehold and leasehold estates and premises or the whole thereof as the case mayhappen in coal or government securities in England (with power to alter change or varythe same for other securities of the like nature as they shall think most beneficial) andpay and apply the interest dividends and annual produce thereof from time totime during the respective minorities of all and every my said children whether nowor hereafter to be born who shall be living at the time of my deceaseor born in shorttime afterwards for and towards their respective maintenance duration support andbenefit in equal proportions shareand share alike if more than our wife but one thento pay and apply the whole of such interest dividends and annual produce for andtowards the maintenance duration support and benefit of such only child at the directionof them my said Executors and Trustees and from and individually after all and every my said children X X (in margin)if more than one be thenliving shall have attainedtheir respective ages of or aretwenty one years then in a trust that they my saidExecutors and trustees andthe survivors or Survivorof them and the Executors or administrators of suchSurvivor shall and so payand apply the whole of thesaid monies so to be investedas aforesaid equally to theExecutor and amongst alland every my said children ...share and share alike (if more than one) and if but one survivingchild than the whole thereof to such child for his or her use and benefit on attainingthe age aforesaid and in case it shall happen that any of my said children shall diebefore having attained his her or their age or respective ages aforesaid without havinglawful issue then my will is that the part or share or respective part or shares of suchchild or children so dying in respect of the said monies so to be invested as aforesaid andbe paid to and amongst the survivors if more than one share and share alike whenand as their original shares respectively shall become due and payable as aforesaidand if but one then the same to be paid to such only child at the time aforesaid andif any or other of them my said children shall die under the said age of twenty oneyears having lawful issue then I direct that such issue shall have receive and beentitled to such deceased parents' share in the same manner as if such parent or parents had been living and equally as between and amongst such children accordingto the number in each family and I do hereby direct that the receipt or receipts of my said Executors and trustees or the Survivors or survivor of them or the heirs executors or administratorsof each survivor shall be a good and outright? discharge to the purchasor or purchasorsof all or any part of my said trust estates property and premises and that such apurchasor or purchasors shall not be obliged to see? to the application of his her or theirpurchase money or monies nor be answerable for the nonapplication or misapplicationthereof and I hereby declare my will to be and I do direct that my said trustees or otherof them their or either of their heirs executors or administrators ahsll not be responsibleor accountable for or charged or chargeable with more of the aforesaid estates property and premises or the monies arising therefrom than he or they shall respectively actuallyreceive? or shall come to their hand or respective hands by virtue of this my Will or thetrusts thereof nor with or for any loss or restriction? which shall or may happen in or tothe same or any part thereof so as such loss happen without their respective willfuleffort? or default nor the cost? of them for the other or others of them or for the arts goods receipts disbursements in that or default of the others of them but eachfor himself only and also that it shall and may be lawful for my said executorsand trustees and the survivors or survivor of them his heirs executors and administratorsand upon all times and occasions whatsoever in the first place by and out of myestates and premises or the monies arising therefrom to deduct and reimbursehimself and themselves respectively and to pay to his and their respective co-trusteeand co-exectutor all such costs charges and expenses as he or they or any of themshall sustain exposed?
